www.carlsbergvietnam.vn is operated by Carlsberg Vietnam Breweries limited, a company registered in Vietnam with registered address Lot B8, Phu Bai Industrial Zone, Huong Thuy Town, Thua Thien Hue Province,  (‘Carlsberg Vietnam’, ‘we’ or ‘us’).  If you experience problems with the site or would like to comment on it, please feel free to contact us.

Privacy Policy

The purpose of this Privacy Policy ("Policy") is to govern (i) what and how Carlsberg Vietnam collects, processes, stores and otherwise uses information about you and/or your Relevant Persons (as defined below), and (ii) on your rights in relation to that information.

This Policy is effective as from 1/7/2023 and applies (i) to  those who undertake any business or make any transaction with Carlsberg Vietnam, including but not limited to our customers, suppliers; (ii) to visitors of our website (https://carlsbergvietnam.vn) (“Website”) and social media channels, (iii) when you contract or correspond with us in any way, whether the data is provided by yourself or your related parties, or collected or acquired by us from other sources according to law and regulations, or based on your or related parties’ consent or authorization.

In this Policy:

  • "we" or "us" or “our” refers to Carlsberg Vietnam;
  • “Personal Data” means any information expressed in the form of symbol, text, digit, image, sound or similar forms in eletronic environment that is associated with a particular natural person or helps to identify a particular natural person. Personal Data includes basic personal data and sensitive personal data;
  • “Relevant Persons” means any natural person whose Personal Data is provided to us by you or any of your representatives and/or any other party which we reasonablely believe to have the legitimate rights to share the information with us through provided information and commitments.   

We may update this Policy from time to time to clarify it or address changes in laws or our business operations. This Policy, including updates to it, will be posted on our Website. Please note that if you continue to use our products and/ or maintain relationship with us, you will be deemed to have accepted such updates.

1. What kind of Personal Data do we collect and how do we process it?

We collect the Personal Data that is related to your business, required to fulfill statutory/contractual obligations, or permitted to be collected under the laws of Vietnam. To the extent permitted by laws, the types of Personal Data we collect include but not limited to:

  1. Name, gender, date of birth, ID information, specimen signature, contact details (such as residential address, contact number, and email address), domicile, marital status;
  2. Employment history, qualifications, professional and educational background, social insurance account, bank account details, tax identification number, criminal record;
  3. Other personal data needed for third-party and trade sanctions screening process, including but not limited to title, shares in companies, financial data, assets, relationship with authorities, and similar transaction information/history;
  4. Data relating to our business relationship and relevant services, including data derived from your usage of our Website and marketing platforms (including fan pages, social media channels) and your engagement in our marketing activities, such as as internet protocol (IP) address, cookie identification, log-in data, network logs, and other network identity data, data you provide as winners of our promotional rewards.

The Personal Data we so collect may be in paper, electronic or any other forms in accordance with the laws. Unless otherwise restricted by the laws, we may collect Personal Data directly or indirectly through communications and interactions with your Related Person.

We have the right to decide the Personal Data processing methods for the Purposes set out in Clause 2 below.  Some of the Personal Data above, specifically in subparagraphs (ii) is considered as sensitive under Vietnam laws. We will use it only for specific purposes and in compliance with the requirements of Vietnam laws. When we collect your Personal Data, we will, as necessary to fulfill any of the Purposes stated in Clause 2 below, use, process, retrieve, organize, encrypt/decrypt, or modify it, share it with the entities within Carlsberg Group, with third parties, including regulators, store it, and delete it in accordance with this Policy and the laws.

2. Why do we need to collect and/or process your Personal Data?

We collect and process the Personal Data for a variety of reasons linked to establish and maintain your relationship with us (“Purposes”), which we have listed below:

  • Compliance with legal obligations, in particular in the area of labour law, social insurance law, data protection law, tax law, commercial law, etc.; response to investigations or disclosure orders from the police, inspector, and tax or other public authorities;
  • Manage and improve our websites, to ensure that the content is relevant and presented in the most effective manner for you and your device and to allow you to participate in/register for interactive features of our services. Furthermore, the purpose is to ensure that only adults of legal drinking age view and interact with our websites. Additionally, the purpose is to keep our websites safe and secure. Our websites use cookies. They help us to provide you with a good experience when you browse our websites and ensure that the content is relevant to you.   • Perform our contractual obligations with you;
  • Protection of the life and health of you or another individual in emergency cases;
  • Evaluation and choose of partners. The purpose is to ensure that we only engage with business partners and suppliers that act in compliance with applicable laws and relevant codes of ethics;
  • Consumer, customer and vendor relationship management. The purpose is to carry out our obligations arising from any contracts entered into between you and us, including to arrange delivery, to action or cancel orders, to provide you with the information, products and services that you request from us, and to notify you about changes to our products and services, to communicate effectively with you, to respond to your questions, comments, complaints or other communications, including any queries relating to our products;
  • Improve our products and service;
  • Activities relating to security;
  • Evaluating, bringing or defending legal claims;
  • Marketing of our products;
  • Run promotions and competitions, or events;
  • Business restructurings.
  • Complete the signing process of the labor contract with the Employees; carry out our rights and obligations arising from or in connection with the labor contract; communicate with the Employee by us or our’s suppliers, customers, partners, agents, professional advisers and/ or other persons relating to tasks that the Employee is in charge in our to contact Employees, archive Employee information, advise on/resolve matters related to Employees; manage our operations to the extent permitted by laws, including but not limited to payroll, income tax and insurance deductions, annual health checks, periodic mandatory reports to authorities or internal reports or considering promotion/new assignment to Employee, administration of compensation and benefits and welfare plans for Employee; to access potential development and career opportunities for Employee; prepare personnel plan for our business plan and build the development plan for person; comply with obligations imposed by any laws and regulations applicable to us; andctransfer the Personal Data to (i) group companies/organizations within Carlsberg Group, (ii) third parties that act as suppliers, partners, agents and/or professional advisers in connection with, or support to, implementation of the labor contract or the works that the Employee is responsible for performing during the course of employment for us, or (iii) a third party (including a competent authority), domestically and internationally, for the purposes above in accordance with applicable laws

3. Who conduct your Personal Data processing?

To ensure that the Purposes can be achieved, your Personal Data may be shared with: (i) third parties that act as suppliers, partners, agents and/or professional advisers in connection with, or support to, establish and maintain our relationships with you; and (ii) companies/organizations within Carlsberg Group. Where we share data in this way, it is our policy to limit the categories of individual who have access to that Personal Data.

Unless otherwise provided by laws, Carlsberg Vietnam may transfer your Personal Data to third parties, including entities within and outside the Carlsberg Group in any jurisdictions for the following processing purposes:

Within the Carlsberg Group.  As Carlsberg Vietnam is part of Carlsberg Group with headquarters in Denmark [see the privacy policy of Carlsberg Group here Global policies (carlsberggroup.com)], and entities located across several regions, Carlsberg Vietnam may transfer the Personal Data to, or otherwise allow access to such Personal Data by, other entities within the Carlsberg Group for the following purposes: (a) to communicate information about the Carlsberg Group; (b) to monitor and assure compliance with applicable policies and procedures, and applicable laws; (c) to respond to requests and legal demands from regulators, auditors and other authorities; and (d) to assist Carlsberg Vietnam in its daily business operations.

Data processors. To the extent permitted by laws, where necessary for the Purposes desrcibed above, Personal Data may be shared with one or more third parties to process your Personal Data under appropriate instructions ("data processors"). The data processors may carry out instructions related to recruitment, workforce administration, IT system support and maintenance, payroll and compensation, training, transportation, payment, and other activities, and will be subject to contractual obligations to implement appropriate technical and organizational security measures to safeguard the Personal Data, and to process the Personal Data only as instructed. 

To serve the Purposes, you agree that we are entitled to transfer Personal Data overseas to the above-mentioned organizations and individuals.

4. How long will we keep your Personal Data for?

We will use and retain your Personal Data for the period required by laws and necessary to achieve the Purposes. In making decision about how long to retain your Data, we take account of:

  • the termination date of the relevant contract or business relationship;
  • any retention period required by laws or internal regulations;
  • any need to preserve records beyond the above period in order to deal with actual or potential audits, tax/legal claims.

5. What data protection rights do you have?

You, as data subjects, have the following rights:

  • Being informed about the processing of Personal Data, unless otherwise provided by laws;
  • Giving consent or not giving consent to the processing of Personal Data, unless otherwise provided by laws;
  • Withdrawing the consent to the processing of Personal Data, unless otherwise provided by laws;
  • Accessing to see, correct or to request to correct Personal Data, unless otherwise provided by laws; 
  • Deleting or request to delete Personal Data, unless otherwise provided by laws;
  • Being provided with Personal Data that we hold, unless otherwise provided by laws; 
  • Restricting to the processing of Personal Data;
  • Objecting to the processing of Personal Data;
  • Complaining, denunciating and suing;
  • Claiming compensation for damages;
  • Self-protection.

When we receive a request to exercise the above rights, we will carry out that request in accordance with the applicable laws and our internal regulations. Notwithstanding the foregoing, we may not be able to accommodate certain requests from you or Relevant Persons to the extent permitted by laws or to comply with applicable regulations or regulatory authorities.

6. Unexpected consequences/damages that are likely to occur

Personal Data security is our top priority. We always endeavor to safeguard your Personal Data against unauthorized or accidental access, processing or damage. We implement appropriate physical, technical, and organizational measures to secure your Personal Data. We also maintain strict security to prevent unauthorized access to our systems that contain Personal Data. However, your Personal Data may pose the risk of data leakage or inappropriate handling of data (i.e., unauthorized loss, misuse, alteration, or destruction).

In case of a personal data breach, we shall take necessary measures to ensure that such incidents are identified and addressed without delay. We take effort to prevent breaches of your Personal Data, as these can have an effect on your legal rights and interests, such as discrimination; damage to reputation; financial loss; or loss of confidentiality or any other significant economic or social disadvantage.
